Allahabad High Court has strongly criticised the Uttar Pradesh administration for restricting the number of people offering prayers at a mosque in Sambhal district during Ramzan, stating that officials must ensure the rule of law rather than curtail religious rights.
A bench comprising Justices Atul Sreedharan and Siddharth Nandan observed that if the Superintendent of Police and District Collector feel incapable of maintaining law and order, they should either resign from their posts or seek transfer.
The court emphasised that it is the duty of the State to ensure that every community can peacefully offer worship at designated places. It further noted that if the place of worship is situated on private property, as previously held by the court, the devotees cannot be required to obtain permission from the State to perform prayers.
The observations came while hearing a petition filed by Munazir Khan from Sambhal district. The petitioner alleged that authorities prevented him from conducting prayers during the holy month of Ramzan at Gata No. 291, where he claims a mosque exists.
