City Judge Abdul Directs Accused and In-laws to Stay Away from Survivor

Srinagar, Aug 1 — A local court has upheld domestic violence charges against a man and his family, directing him to pay ₹10,000 per month to his estranged wife and their minor child, and restraining him along with his family from interfering in her life.
In a judgment delivered by City Judge Abdul Bari, the court held that Sabeen Iqbal Mir, a journalist by profession, had “successfully proved the allegations of domestic violence” against her husband Naveed Bashir and his family members.
The court directed Naveed to pay ₹10,000 monthly as maintenance to Sabeen and their two-year-old son before the 5th of every month. Additionally, the judge issued a restraining order, preventing Naveed and victims’ in-laws from causing any interference or harassment in the life of the petitioner “at any point of time.”
The judgment came in response to an application filed by Sabeen under Section 12 of the Protection of Women from Domestic Violence Act, 2005 through her council Advocate Aamir Masoodi and Associates.
She had alleged that shortly after their marriage in 2018, she was subjected to physical, emotional, and economic abuse by her husband and in-laws. The petitioner also accused her husband of illicit relationships, character assassination, and forcefully taking back her mehr and gold ornaments.
According to her petition, Sabeen, who now lives with her child at her parental home, was working as a journalist with a modest income which was not enough to take care of her and the child.
The petitioner had also sought maintenance and compensation for emotional distress, and an alternate residence. While granting partial relief, the court acknowledged the cruelty inflicted on the petitioner and issued protective directions accordingly.
