The Honorable High Court of Jammu and Kashmir and Ladakh has stayed the investigation in an FIR lodged against a practicing lawyer for alleged misconduct during court proceedings. The FIR was registered on a complaint filed by a Public Prosecutor under various provisions of the Bharatiya Nyaya Sanhita.
The registration of the FIR against a practicing advocate was strongly condemned by several Bar Associations. They termed the action unjustified and detrimental to the legal profession.
The concerned Bar Association engaged Advocate Arshid Bashir a practicing lawyer in J&K High Court to represent the accused lawyer before the Honorable High Court and to challenge the legality of the FIR. The FIR was questioned on multiple legal grounds. After hearing the matter, the Honorable High Court expressed prima facie satisfaction and stayed the investigation.
Reacting to the order, Advocate Arshid Bashir said the stay has provided significant relief to the petitioner and has been widely welcomed by the legal fraternity across Kashmir. He stated that prosecuting a lawyer for acts performed in the course of professional duties undermines the independence and dignity of the Bar and the legal profession as a whole.
Advocate Arshid Bashir appeared in the matter along with Advocate Asif Bhat.
Advocate Arshid Bashir is a practicing lawyer before the Honorable High Court of Jammu and Kashmir and Ladakh. He also regularly appears before the Honorable Supreme Court of India and various High Courts across the country. He hails from Sultanpora, Kandi, Baramulla. He holds an LL.B. degree from the University of Kashmir and a Post Graduate Diploma in Corporate Law and Management from the Indian Law Institute, New Delhi.
