Kashmir Bar Association Calls for Immediate Restoration of Judicial Powers; Seeks Revocation of Revenue-Centric Circular
The Kashmir Bar Association, Srinagar, under the leadership of its President Advocate Haamid Bhat, has unequivocally extended support to the statement issued by the President of the J&K High Court Bar Association, Jammu, concerning the urgent need to restore judicial powers to the rightful domain of the judiciary.
Advocate Haamid Bhat stated that the transfer of critical judicial and quasi-judicial powers from Judicial Officers to Revenue Officials has resulted in institutional imbalance, legal misapplication, and avoidable hardship to the advocate fraternity across the Union Territory.
“The revenue machinery, with due respect, is neither adequately trained nor sufficiently equipped with the required legal acumen to adjudicate matters that inherently demand judicial scrutiny,” Advocate Bhat asserted. “This diversion of authority has led to harassment of practising advocates and has created unnecessary procedural bottlenecks.”
Calling the move legally untenable and administratively counter-productive, the Association has urged the Hon’ble Lieutenant Governor, Shri Manoj Sinha Ji, to immediately withdraw the circular conferring executive and quasi-judicial powers upon revenue officials and restore them to the Judicial Officers, where they traditionally and lawfully belong.
“If the legal fraternity does not safeguard the sanctity of judicial processes, who will? No institution holds greater competence in the domain of law than an advocate,” Advocate Bhat said, reiterating the Bar’s unwavering commitment to upholding justice, legal propriety, and institutional integrity.
The Kashmir Bar Association reaffirmed its resolve to stand united with all Bar bodies across Jammu & Kashmir in defense of judicial independence and the rule of law.
